The Congressional Research Service Report, “Detention of U.S. Persons as Enemy Belligerents” by legislative attorney Jennifer Elsea examines the applicability of the detention of enemy belligerent captured in relation to hostilities by the United States. The report, more specifically analyzes the existing legislation to detain U.S. individuals including citizens and resident aliens and other persons within the U.S. who are suspected of having any links with terrorist organization as “enemy combatants.” The author examines the provisions of the National Defense Authorization Act that gives the United States authority to use military force following the terrorist attacks of September 11, 2001.
