Intellectual Property or IP has many forms, and can be an important intangible asset that can complement the existing tangible assets of a business, such as funds/cash, machinery or real estate, or other business related non-IP assets such as a list of important potential customers, business know-how, or staff expertise.
Commercialisation of IP means extracting value from the IP by marketing a new product, production method, or service based at least partly on the IP; in other words, bringing a creative, novel or a unique idea to fruition and turn it into a valuable asset. Examples of simple IP commercialisation include movie and cinematic (artistic) productions, books, electronic devices, machine designs, software code and applications, and music.
In this task, you will be required to research and report on an analysis of current intellectual property laws, tools/mechanisms, best practice of IP management, and approaches to managing intellectual property. a sample organisational profile will be provided for the purpose of creating a real-life context. You may also use example/s of your current or past organisations in consultation with your trainer/assessor. If any other organisation is used, ensure that you obtain approval from your trainer/assessor prior.
For simulation purpose, your trainer/assessor will play the role of your Manager (Intellectual Property Manager).

You will be provided with a sample Strategic Plan for the sample company/business used in this task. Consider the following profile;
AgriFutures Australia is a new beginning for the Rural Industries Research and Development Corporation (RIRDC). AgriFutures focuses on the future of Australian agriculture through its presence in the rural regions and representing the interests and aspirations of farmers and rural communities. This assessment task uses the business/organisational profile and the research information used in Assessment Task 1.
Intellectual Property (IP) is a term used to describe various exclusive proprietary rights to designs, concepts, codes, methods, and many other creative concepts of mind. IP includes copyright, trademarks, patents, trade secrets, and business know-how. In most cases, to protect IP, organisations or people would need to register it to gain protection. Different IP rights vary in the protection granted. An IP owner can take steps to enforce their rights against people who are violating them.
In this assessment task, you will be required to develop and implement strategies for intellectual property management. Implementation would require a simulates session where you will be conducting a consultation and feedback session with the class audience playing the role organisational stakeholders. The session will be planned, scheduled and organised by your trainer/assessor. For the purpose of this task, your trainer/assessor will also play the role of an Intellectual Property Manager.
This task has two parts. Both the parts must be completed.
Part A: Strategy Development
Assume that you work as a Project Office for the case/sample organisation. Following your earlier presentation (Assessment Task 1), assume that your Manager (trainer/assessor roleplay) has asked you to develop appropriate IP protection strategies and implement within the department. Implementation would require allocation of roles, responsibilities, key targets, and workflow management.
As a guide, elements of a sound strategy consist of three key corelated and important aspects (Rumelt, 2014).
Diagnosis: A clear definition of the nature of the challenge. A diagnosis simplifies a complex situation and identifies certain aspects as critical.
Guiding Policy: An overall policy or approach for overcoming the obstacles identified in the diagnosis. Set of Coherent Actions: The coordinated actions set out to accomplish the guiding policy.
Accordingly, develop appropriate strategies in a document that include;
Strategic objectives
IP and the case for commercialisation of IP
Strategic approach to IP management
Brief/explanation to stakeholders
Proposed strategies
Strategies for dealing with infringements
Overview of the legislation and engagement of IP lawyers

Develop the above with a view that you will need to assign specific tasks/measures to different stakeholders. For justification purpose, provide comparative examples of other companies/organisations with similar IP needs. The strategy document should be written as a formal document with appropriate structure, format, and presentation. Prepare a draft and obtain approval on the structure and the scope of contents from your Manager (trainer/assessor roleplay) in preparation for implementation.
Part B: Implementation
Assume that your IP Management Strategies have been approved by the management and you have been tasked with implementing the strategies within the project team. In a typical workplace environment, implementation would be a stepped process and monitored over a long period time. In a classroom environment, implementation will be simulated. For the purpose of this task, the class audience will play the role of the project team members. Your trainer/assessor will continue play the role of the Intellectual Property Manager.
You will be required to emulate implementation process by;

? Communicating requirements for implementing the plan – Action plan stages
? Key stakeholder and consultation process in implementation
? Allocation of role and responsibilities

Ensure that you take notes from the meeting. Also ensure that you explain each step and seek feedback. Based on the discussion, articulate implementation process and assign responsibilities within the roleplay. The session will be planned and scheduled by your trainer/assessor.
You will be required to submit a final report summarising the meeting, audience suggestions, processes deployed for implementation and measures in place for continuous improvement.

In a competitive environment, the preparation of an IP Management Plan starts with an IP audit and development of an IP policy. A well written IP policy can help to manage the processes, risks and accountabilities for all of the creative activities of the organisation. The IP Management Plan should also contain measures for monitoring, revision and reporting on the IP policy as well as a mechanism to review the policy to keep it dynamic and relevant.
In Assessment Tasks 1 and 2, you had gathered the relevant information and developed the structure and components of an IP Management plan through strategy development and implementation. In this assessment task, you will need to bring all the components together to build and present a formal IP Management Plan for the given organisation.
Organisational profiles used Assessment Tasks 1 and 2 will also be used in this task. You will continue to play the role of Project Officer. For the purpose of this task, your trainer/assessor will play the role of your Manager. The class audience will play the role of organisational stakeholders. Roleplay sessions and activities will be organised and scheduled by your trainer/assessor.
You will need to review the strategies developed in Assessment Task 2, including the adjustment made in the implementation process, and develop an IP Management Plan.
Students should note that they need to complete Assessment Task 2 and obtain trainer/assessor’s approval prior to undertaking this task. If you have not completed Assessment Task 2, contact your trainer/assessor at the earliest.

Learners have also been provided with the assessment criteria in the “Learner’s Guide” to ensure that they cover all the task requirements. The same criteria are used in the checklists in Section 8 (Learner Competency Records) to record assessment outcome.
