who has the best chance of getting out of the contract due to unconsionability?

Ashford 3: – Week 2 – Discussion 2

The Uniform Commercial Code (UCC)

Read the Ace Heating and Cooling scenario in your text and answer the   following questions:
a.    Under UCC 2-302, who has the best chance of getting out   of the contract due to unconsionability?
b.    The symbol for justice features a woman wearing a   blindfold illustrating that the law should be applied the same way regardless   of who the parties are. Does the UCC rule seem to contradict this? Which   approach do you think is more ethical?
c.    Note that both Glamour and Shady Rest are businesses,   and courts rarely find that contracts between two businesses are   unconscionable. The rationale is that a business is a sophisticated entity,   familiar with transactions and able to protect itself. Do you think Glamour   and Shady Rest are in a comparable position in regard to this contract? Why   or why not?
Guided Response: Respond to at least two of your classmates, explaining your   position and why you agree or disagree with their comments. Do you think the   contracts are fair or unfair considering the parties had a disproportionate   ability to bargain? Under UCC Section 2-302 the court has the discretion to   find the contract unconscionable. Do you think this is a good approach? What   other methods to resolve this issue is appropriate?

Ashford 6: – Week 5 – Final Paper

Final Paper
The summative assessment for this course is a Final Paper that is due in Week Five.  For your Final Paper, you must demonstrate an understanding of a topic in psychology beyond the information presented in the course textbook.  Incorporate material from across the course, by describing and applying psychology knowledge as you integrate new research findings, into a cohesive and well-written paper.  This learning activity will facilitate the development of research techniques, critical thinking, and writing skills that are necessary to be successful in the field of psychology.  You may include personal experiences as examples to explain concepts and inform your audience.
You will have already selected a research topic from the list below in Week Three of the course.  You must continue to use your selected topic.  The topics include:

  • Is corporal punishment needed to discipline children?

To begin, research the chosen topic using scholarly resources and craft a thesis statement regarding your selected topic.  For assistance with creating a thesis statement, visit the Ashford Writing Center or the Ashford University Library.  Your Final Paper must contain at least five references from scholarly sources that were published within the last five years and are cited according to APA style as outlined in the Ashford Writing Center.  Examples of scholarly sources include: peer reviewed journal articles, research studies, professional websites with authored material, and government websites.  Popular internet sites (Wikipedia, Newsweek, New York Times, etc.) are not considered scholarly sources.
Then, address the following criteria as you write your Final Paper:

  • Include a well-written introduction with a succinct      thesis statement and a conclusion that reaffirms your thesis.
  • Integrate research findings that address the selected      topic.
  • Discuss the key issues and controversies surrounding      your selected topic.
  • Discuss multiple perspectives on the selected topic, so      that the discussion is balanced and not one-sided.
  • Include a summary and analysis of the findings from the      research.
  • Include any additional research that could be done in      the future, and provide solutions that could be implemented in the present      regarding your selected topic.
  • Consider the cognitive and behavioral implications      might play a role in your selected topic.  What learning principles      could factor into the topic?  What theories of motivation and      personality could influence your insights into the topic?

Writing the Final Paper
The Final Paper:

  1. Must be eight to ten double-spaced pages in length      (excluding title and references pages), and formatted according to APA      style as outlined in the Ashford Writing Center.
  2. Must include a title page with the following:

Special   Populations – A Challenge to Juvenile Justice

Chapter 9 of the text addresses special populations of juveniles that pose significant problems to the juvenile justices system. Assume you were writing a proposal to a city or state administrator to address one of the special populations identified in our text (e.g., early starters, juvenile gangs, or juvenile sex offenders) and explain why juveniles in the this category must be treated outside the normal juvenile delinquency programs. What are the benefits to this program in addressing the special population? What is the measure of effectiveness for these programs? Why will this program be effective countering the problem addressed?
Your initial post should be at least 250 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts by Day 7 and continue to support your arguments with examples from the required material(s) and/or other scholarly resources.
Considering the goals of juvenile justice system and our desire to return juveniles to the community as productive members of society, support an alternative approach to the one held by your classmates. Assume you were writing a proposal to a city or state administrator competing with the proposal of your classmate. Highlight the benefits of your alternative program to address this challenging special population. Keep in mind that, due to limited funds, only one program will be selected for implementation.

Determine the Quality of Information

Ashford 4: – Week 3 – Assignment

Determine the Quality of Information

As mentioned previously, at the end of this course, you will create an “Annotated Bibliography” Final Paper on a topic within your major field of study. This week, you will begin to evaluate websites related to your research question. The websites you evaluate may be used in your Final Paper in Week Five. First, watch the video below to understand the process.

Read the handout Evaluating Information – Applying the CRAAP Test and view Google Inside Search: All Tips & Tricks before completing this assignment.

Now that you have a basic understanding of what the Currency, Relevance, Authority, Accuracy, and Purpose (CRAAP) Test is and how to effectively search for information online, it is time to apply this method to the evaluation of web sources. In this assignment, you are tasked with locating three websites that will help you answer your research question. Two of these websites must pass all five criteria of the CRAAP Test.

Using the                     Determine the Quality of Information Worksheet, you will apply the elements of the CRAAP test to your chosen websites. You are expected to provide a brief evaluation of how each website met or did not meet the requirements of the CRAAP Test, as directed in the worksheet. You will also reflect on the differences you found between the two websites that passed the CRAAP Test and the one that did not. Download the worksheet to your computer and save it in an easy to find location. You will then complete the worksheet based on your research and evaluation of websites, saving your final work.

View this   Determine the Quality of Information Worksheet (Example) to guide you as you complete this assignment.

Once you have completed the Determine the Quality of Information Worksheet, submit the completed worksheet through the Assignment Submission button in the online classroom.

In this class, you have three   tutoring services available: Paper Review, Live Chat, and Tutor E-mail.   Click on the Ashford Writing Center (AWC) tab in the left-navigation menu to   learn more about these tutoring options and how to get help with your   writing.

Carefully review the Grading Rubric for the criteria that will be used to evaluate your assignment.
