Section IV.  CASE ANALYSIS (Max. 30 Points)

This Section requires the student to review 1 Case Scenario and respond to two short answer questions worth a total of thirty (30) points.  The written responses should demonstrate the student’s knowledge of both the legal principles involved in the Scenario and critical thought in applying the legal principles to the Scenario provided.  Write your short answers in sentence and paragraph form to each of the following questions after reviewing and analyzing the Scenario.  No plagiarism or academic dishonesty will be tolerated.  All work must be your own and solely the result of your individual efforts.  

Scenario:   Jenny was her grandfather’s favorite.  Upon his death, she inherited $100,000.00 and embarked on a new business venture with her inheritance.  She decided to go into the apparel business and created a line of women’s sportswear bearing her brand “AngelWear,” named with her grandfather in mind.  Sally, the owner of a local Boutique, loved Jenny’s new line and encouraged Jenny to return in a few weeks when Sally would be ordering for the next season.  Jenny did so and showed Sally several new pieces in addition to samples of her previously demonstrated products.  Sally was thrilled to see the new pieces and indicated that she would be happy to order and dedicate significant floor space to Jenny’s new line.  After leaving the Boutique and returning to her office, Jenny ramped up production and sent Sally an e-mail that offered a discounted wholesale price of 70% off of the MSRP for each piece for being her first customer and advised that delivery can be made within 3 days.  In a reply e-mail, Sally thanked her for her generosity and told her that she would be in touch shortly.  Jenny’s joy turned into disappointment when she did not hear from Sally for an entire week.  Both ladies played phone tag for the better part of the following week, leaving general messages for one another until, frustrated by the situation, Jenny visited Sally’s Boutique again.  Jenny was stunned to see that the space she thought would be dedicated to her line was filled with a competitor’s apparel.  Sally was not present at the time and Jenny left angry at what she had seen and the significant costs she expended in ramping up the production of her new line for Sally’s Boutique.

(A) Analyze the above Scenario to determine if a valid, legally enforceable Contract existed (explaining all relevant, legal contract principles) and whether Jenny will be successful in a lawsuit against Sally and Sally’s Boutique for breach of contract or to recover her damages otherwise? (20 Points)  (B) What is the doctrine of “promissory estoppel” and would the application of that doctrine afford Jenny any rights in the absence of a valid, enforceable Contract with Sally?  (10 Points)

Section V.  OPTIONAL EXTRA CREDIT (Max 10 points)

Consider the following scenario and explain the most likely result?  Be sure to provide your legal reasons and analysis in two or three paragraphs in support of your conclusion.

Case Scenario:

Ivan is a 21 year-old owner of a landscaping and lawn service business in Greenville, NJ.   Virgil is an adult customer of Ivan’s services and had been for six months.  As the winter season approached, Ivan spoke to Virgil about drumming up business in Virgil’s neighborhood for his new snow removal division.   Ivan told Virgil that he will take $10 off Virgil’s monthly landscaping bill for six months, starting in March of 2021, for each new customer that Virgil refers to Ivan for snow removal at Ivan’s snow job rate of $100 per house.   Virgil tells Ivan that he is willing to help out and use his best efforts to do so.  Ivan then handed Virgil thirty fliers that bore Ivan’s name, phone number, some marketing graphics and a general description of the snow removal services offered at the $100 rate discussed.  The flyer also advised of a “New Customer Discount Available.”  Virgil thanks Ivan for his anticipated assistance and the two men quickly conclude their business in a cordial manner.

Virgil gave Ivan’s flyers to twenty of his friends and neighbors and spoke favorably to them about Ivan’s new service.  Fifteen of them agreed to use Ivan for their snow removal services.  In the winter months, 12 of these friends/neighbors did use Ivan for snow removal on at least one occasion.  Ivan performed the initial services requested by Virgil’s friends and neighbors and gave them all his discounted, new customer rate of $75 for their initial snow removal job.  Ivan also advised each new customer that his standard rate of $100 would apply to their second and subsequent snow removal jobs when requested.   Only 3 of Virgil’s referrals used Ivan a second time.  Ivan charged these three referral customers 100 for their second and subsequent snow removal jobs.  All three of these referral customers offered the flyer that Virgil gave them to their friends and families when Virgil told them that Ivan agreed to give him a $10 discount off the price for services for six months for each new customer he referred to Ivan.  As a result of the referrals from these 3 friends of Virgil, Ivan received five new repeat customers.

In February 2021, Virgil caught up with Ivan and asked him to begin his regular landscaping services again in March.   During the course of the conversation, Ivan thanked Virgil for his assistance and referral of three new customers to him, and gratefully advised Virgil that he would receive a credit on his monthly landscape bill in the amount of $30 for the next six months as promised.   Virgil was surprised to hear that he would receive only $30 off his monthly landscaping services and protested to Ivan that he sent him more than ten referral customers for which Ivan provided snow removal services.   Virgil told Ivan that he expected to receive a full $10 credit off of his Spring/Summer services for six months for every snow removal job that Ivan performed for all 12 of the referrals that Virgil provided and Ivan serviced.   Ivan sarcastically said “yeah, right!  You just want free services from me” and exclaimed “that was certainly not part of any deal that we had.”   Both men became angry at one another, exchanged hostile words and Virgil walked away frustrated and outraged that he would not get the full amount of the credits that he anticipated.   Just before leaving, however, Virgil threatened to hire another landscaper, to sue Ivan for breach of contract and to recover the amount of a monthly credit of at least $120 for the Spring/Summer months, as well as any difference in price should the new landscaper charge him in excess of $100 per month for such services.

Did Ivan and Virgil have a valid, enforceable Contract?  In your answer, be sure to explain whether there was a meeting of the minds between the two and the relevant, legal principles used to determine whether a meeting of the minds exists, whether any such agreement formed a bilateral or unilateral contract and to identify the material terms of any such Contract.

Instructions:

Communication is used to inform, to persuade and to analyze. In this assignment, you will persuade the reader of your point of view by supporting a thesis with objective facts and credible evidence.

In the week 2 forum, you selected your topic for this paper. You will take a stance on this issue and support your stance with credible evidence in your body paragraphs.

For this assignment, you have traditional and creative options. Choose what will challenge your writing and what would be appropriate for your topic and field:

  • Traditional 5 paragraph essay with 1 paragraph introduction, 3 body paragraphs, and 1 paragraph conclusion.
  • Op-ed newspaper article.
  • Blog post.
  • Letter/proposal to stakeholders.
  • Press release.
  • Letter to the editor.
  • Presidential address.
  • Election speech (written only).
  • Application for a position related to the topic.
  • Defense attorney’s opening statement.
  • Case brief.
  • Advocacy statement.

Guidelines:

In order to persuade the audience to accept the position you are advocating in this paper, you will use different kinds of appeals:

  • ethos (which involves the credibility of the speaker, writer, or authority being cited);
  • logos (which involves facts, statistics, and logic); and
  • pathos (which involves emotions).

A good persuasive argument uses credible sources, objective evidence, and emotional “hooks” to make use of logos, ethos, and pathos respectively.

Be sure your thesis statement is very clear.  It should be a single complete sentence, including both a subject and a predicate, that combine to make claim. Example: “The USA should be more competitive in establishing a presence on Mars.”  Your introduction paragraph should include a “hook” to grab the reader’s attention.  The thesis statement is typically seen in the first paragraph. Your body paragraphs will support the thesis. You should use credible sources and cite them according to the style of your discipline. Your conclusion should reiterate the strongest points from your paper and give the audience something to consider, moving forward.

  • AUDIENCE:   The applicable audience for the type of document you’ve chosen to write.

Communication is used to inform, to persuade and to analyze. In this assignment, you will write a speech that provides your audience information about a topic.

There are two (2) parts to be submitted in this assignment.  Your presentation should be submitted as follows:

  • A Power Point presentation file that is like a visual outline, with bullet points and maybe images. This is what you would show your audience.
  • A Word document containing the wording of the speech.  This is what you would say to your audience while you are showing them the Power Point presentation.

You may add audio to your PowerPoint if you wish, but the script (Word doc) will still be required.  This allows us to process all assignments in Turnitin.

Your speech should be between 1000 – 1250 words. It\’s important to stay within that range.  Good writers learn to adapt to size requirements of the writing they are asked to do.  You can use the word count of both files to calculate the total word count.

Your speech should include an introduction which identifies your main point, a body in which you provide support for your main point, and a conclusion that wraps up your presentation and says something about the significance of what you’ve presented, just as you would do in a paper.  The templates attached here give you good ideas of how the presentation and the speech script should look.

Be sure to look at the grading rubric for the assignment. There are specific limits on the amount of text on the slides. This is to help ensure that the font size stays big enough to be easily read.  You also need to provide a reference list as the last slide in your Power Point.

Read the following scenario.

Answer the questions that follow. This will be a 2-3 page submission in a question and answer format (also in paragraph form). An introduction and conclusion are not required.

Refer back to your textbook for guidance on how to think through the scenario.

 

You have been recently hired as an assistant controller for XYZ Industries, a large, publically held manufacturing company. Your immediate supervisor is the controller who also reports directly to the VP of Finance. The controller has assigned you the task of preparing the year-end adjusting entries.  In the receivables area, you have prepared an aging accounts receivable and have applied historical percentages to the balances of each of the age categories.  The analysis indicates that an appropriate estimated balance for the allowance for uncollectible accounts is $180,000.  The existing balance in the allowance account prior to any adjusting entry is a $20,000 credit balance.

 

After showing your analysis to the controller, he tells you to change the aging category of a large account from over 120 days to current status and to prepare a new invoice to the customer with a revised date that agrees with the new category.  This will change the required allowance for uncollectible accounts from $180,000 to $135,000. Tactfully, you ask the controller for an explanation for the change and he tells you “We need the extra income, the bottom line is too low.”

Forum Objective: Analyze ethos, logos and pathos in an article from your field.

A persuasive argument is most convincing when it appeals to readers in the ways they would be most moved. Since readers are moved by different elements, it is important we appeal to as many readers as possible:

  • Ethos—credibility of author, credibility of sources, morality, values
  • Pathos—emotions, sympathy, empathy, relevance, personal connection
  • Logos—logic, research, data, reasoning, irrefutable proof, sound explanations

Step 1: Read these articles about types of appeals and then follow the instructions below.

Ethos This appeal to credibility is known as “ethos.” Ethos is a method of persuasion in which the speaker or writer (the “rhetor”) attempts to persuade the audience by demonstrating his own credibility or authority.

Pathos Pathos offers a way for the audience to relate to the subject through commonly held emotions. However, it is important to determine when pathos will be useful and when it will only serve to muddy the argumentative waters.

Logos Logos is the appeal to logic. Logos isn’t logic like the formal logic in math, philosophy, or even computer science; it is the consistency and clarity of an argument as well as the logic of evidence and reasons.

 

Step 2: In your chosen discipline, find an article, ideally one that is persuasive to make the task easier, but even a scholarly, informative article can still have evidence of the appeals.

  1. Go to the APUS Library.
  2. Navigate to the Articles & Databases tab of the large search box at the center of the library homepage.
  3. Search for topics in your field.
  4. Find an article related to your Week 5 Position Paper, something you might use as a source for the project.
  5. Read it for the three (3) rhetorical appeals.

 

Step 3: Decide which of the three (3) rhetorical appeals you want to focus on in this forum: ethos, pathos, or logos. Your initial post may address all three but your focus should be on one.

Step 4: Go to the thread that is marked with the appeal you are going to focus on. In your initial post, provide the link to the piece you evaluated and discuss how this appeal is used in the article. Provide examples or detailed descriptions to support your determinations.

  • Thread 1 – Ethos.  Does this article you selected have ethos? (Ethos is not the same as ethics. It has to do with author credibility.) How is the author an expert in the field?  What is your view of the author’s credibility, based on the article itself and what you know about the author? This week your signature assignment takes you to the movies. For this assignment you will watch one of the movies listed below. Then you will write an analysis paper drawing on everything that you have learned in the course. You will analyze the movie and complete a cohesive and comprehensive paper responding to the prompts below. Ensure the paper is organized in a way that shows each of the prompts are addressed.

Impact of Chronic Illness (Heart Disease and Stroke)

Summary of the Interview

The questionnaire was given to a 55 year old woman called B.T. She is a close family friend who currently copes with heart disease and stroke. She first experienced this problem one year ago when she had a heart attack and a stroke within a one-month period. She has had a fairly satisfactory experience with her healthcare provider. However, she feels that the treatment is currently quite expensive. Nonetheless, the experience has made her alter lifestyle and she now engages in regular physical activity and consumes a healthy diet.

Analysis of the Interview Responses

From the interview responses, it is clear that B.T. is taking her medical condition very seriously. After her near death experience, she has made a lot of effort towards ensuring that she has a low probability of getting another heart attack or a stroke. B.T.’s family has no history of stroke or heart disease. Therefore, her condition is down to her previous poor lifestyle choices. She has since changed her ways and only consumes healthy foods instead of junk foods. Also, she does regular exercises and a considerable amount of physical activity. She takes all her medication on time and goes for her therapy sessions as scheduled.

In addition, B.T.’s physician has comprehensively educated her on all the early warning signs to look out for and how to respond if she experience any of them. More so, her friends and family are aware of these signs and know what to do in case she experience an impending heart attack or stroke. Therefore, she has a strong support system to aid her in the management of her chronic illness. Due to the steps she has taken, her health has significantly improved and she has never experienced another episode of heart attack or stroke. Also, her mobility has improved considerably.

How the Information Will Impact the Care Plan Development

The information provided will be very helpful in the formulation of a good care plan. From her responses, it is clear that B.T. has responded positively to her setback. Despite getting a chronic illness, she has gone out of her way to adhere to her physician’s advice and treatment plan. She is actively taking part in the restoration of her health and has even included her family and friends as a strong support structure for her recovery. Therefore, creating a care plan for such an individual will be relatively easy.

According to Hill, Carson, and Vitale (2019), a good care plan has a high likelihood of enhancing a patient’s quality of life, lower the chances of hospitalization, and improve the patient’s mortality. Additionally, good care plans are crucial in maximizing the patients’ health potential vial pharmacological and lifestyle interventions. Based on B.T.’s response so far, it is clear that the inclusion of a comprehensive care plan will help her since she is an individual who adheres to her physician’s recommendations. Nevertheless, it is vital to get more information on B.T’s case with regards to certain elements that might impact the creation of a care plan. This way, it will be easy to enhance the quality of care and support given to her.

First, there is the issue of communication and information. According to NHS Scotland. (2009), poor information-giving and communication on the part of healthcare practitioners often leaves pertains being anxious, confused, and disempowered. This is surprising considering that chronic illness patients require confidence, reassurance, and strength to cope with their conditions. Although the current physician attending to B.T. is doing well to communicate effectively with her patient, it is vital that the care plan developed is good enough to ensure that even is the physician is changed, B.T. will continue having a good relationship with her physician with regards to open communication and extensive education on her condition.

Second, there is the issue of self-management. NHS Scotland (2009) notes that self-management is vital in patients such as B.T. The patient plays a central role in his/her recovery or disease management. Therefore, the care plan should be comprehensive enough to include vital information to aid B.T.in effectively managing her condition. Finally, there is the issue of preparing for other conditions that are related to heart disease and stroke. For instance, Hill, Carson, and Vitale (2019) assert that such patients are at risk of cognitive decline. Therefore, the care plan must contain a section that highlights the need for patients to undergo regular checkups to ensure they do not succumb to the conditions that heart disease and stroke patients are prone to. This is vital in ensuring that B.T.’s care not only focuses on heart disease and stroke, but is comprehensive enough to prepare her for further chronic illnesses early enough.

1. “On a scale of 1 to 10, what is your satisfaction level with the healthcare services you get from your healthcare provider with regards to your chronic illness?”

Response: My satisfaction level is a 7. My physician has been very helpful in helping me cope with my condition. She does not only offer treatment but also gives me advice on preventive measures to ensure I manage my heart condition. However, the treatment is quite costly. Despite having health insurance, I still find myself spending extra to get the best medical attention available.

2. “Are there any negative side effects of the current medication and therapy you are using to manage your condition?”

Response: So far, there have been no side effects from the medication I am taking. I have been using anticoagulants and antiplatelet agents for the past one year. The former aids in the prevention of recurrent strokes while the latter prevents the formation of blood clots.

3. “Are you indulging in preventive measures such as physical activity and eating a healthy diet?”

Response: Yes, I partake in motor-skill exercises to enhance my coordination and muscle strength. This therapy has been helpful in restoring my abilities after the stroke. Also, I have dumped junk food and now only consume a healthy and balanced diet. I feel that this new lifestyle is improving my overall health.

4. “How confident are you in your ability to identify the signs and symptoms of an impending stroke or heart attack?”

Response: I feel fairly confident in identifying early signs and symptoms of a heart attack or a stroke. My physician has been very helpful in this regard. She has comprehensively educated me on all the early warning signs to look out for and how to respond if I experience any of them. Additionally, my friends and family are aware of these signs and know what to do in case I experience an impending heart attack or stroke.

5. “Kindly list three things that you require from your healthcare provider to enhance your quality of living and help you effectively manage your chronic illness.”

Response: First, I need my healthcare provider to find ways of subsidizing my treatment. Second, I need my healthcare provider to include my close friends and family in the sensitization program where they are educated on my condition. Finally, I need my healthcare provider to promote the importance of preventive healthcare in dealing with this chronic condition, not only for me, but other people who are at risk of getting heart disease or stroke.
